Terms of Service

These Terms of Service (“Terms”) govern your access to and use of The Multiverse AI (the “Service”), operated by The Omniverse LLC (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms.
How we handle your personal data is described separately in our Privacy Policy.
1. Eligibility and account
You must be at least 18 years old to use the Service. You agree to provide accurate information when creating your account, and to keep your login credentials secure. You are responsible for all activity that occurs under your account.
2. The Service
The Multiverse AI provides AI-generated headshot and image generation tools. You upload input photographs, we train a private model from them, and we use that model to produce new images based on your input and the styles you choose. Output quality may vary, and the Service is provided on an “as is” basis.
3. Your photographs
You retain ownership of every photograph you upload. You grant us a limited licence to process those photographs solely to provide the Service to you — to train a model personal to you and to generate your images. We do not use your photographs to train or improve any general-purpose or shared AI model. The model trained from your photographs is private and never publicly accessible.
3.1 What you may upload
You may only upload photographs of yourself, or photographs of another person for whom you hold that person's explicit permission. You must be able to evidence that permission on request.
- Do not upload photographs of anyone who has not agreed — including friends, family, colleagues, and any public figure you do not represent.
- Do not upload photographs of anyone under 18.
- Do not upload photographs you do not hold the rights to, including photographs in which a photographer retains copyright, unless you have their permission.
3.2 Team purchases
Where you purchase for a team, each individual must accept these terms at the point their own photographs are submitted. You may not accept on their behalf, and the Service will not permit it: consent is recorded against each individual account, and no training can begin for a person who has not given it themselves.
3.3 Enforcement
We may remove content and suspend or terminate accounts where we reasonably believe this section has been breached. If you believe a photograph of you has been uploaded by someone else, contact us at support@themultiverse.ai and we will remove it.
4. Nature of the images
The images we produce are created by artificial intelligence from the photographs you provide. They are a faithful representation of the actual person depicted — preserving their real facial geometry, identity and expression — created through a different medium rather than captured by a camera. They are not photographs of events that occurred.
Every image we deliver carries machine-readable metadata identifying it as AI-generated, in line with Article 50(2) of the EU AI Act. The marking is invisible and does not alter the image. Note that many websites and platforms strip metadata from images on upload, which is outside our control.
5. Your use of the images
You own the images generated for you and may use them for any lawful purpose, personal or commercial. You must not use them to impersonate another person, to misrepresent who you are, or in any way intended to deceive.
If you publish these images in the European Union in a professional or commercial capacity, we recommend including a short disclosure on your website — for example on your About Us page or in your footer — that some visual content has been produced or enhanced using AI. Our position, which is not legal advice, is that an accurate portrait of a consenting, identified individual does not constitute a “deep fake” under Article 3(60) of the EU AI Act, because it does not falsely appear to be authentic or truthful about the person depicted. Individuals using their images for purely personal, non-professional purposes are not subject to the deployer obligations in Article 50(4). Further guidance is in section 12 of our Privacy Policy.
6. Payments, credits and refunds
Certain features are paid and may be priced as one-time purchases or credit packs. All prices are shown at checkout. Credits are non-transferable and have no cash value. Except where required by law, payments are non-refundable once the underlying compute — training or generation — has begun and completed successfully.
If a training run fails, we automatically return the credit to your account so you can try again at no additional cost. You do not need to contact us for this, though you are welcome to if something looks wrong.
7. Retention and deletion
Your uploaded photographs, generated headshots and trained model are deleted on a schedule rather than kept indefinitely. We email you before deletion and offer a paid extension. The full schedule, and how to request earlier deletion, is set out in section 10 of our Privacy Policy. Please download anything you want to keep.
8. Acceptable use
In addition to section 3, you agree that you will not:
- Use the Service to create misleading, defamatory, sexually explicit, harassing, or otherwise unlawful content.
- Attempt to impersonate another person or misrepresent your identity.
- Reverse engineer, scrape, or attempt to extract the underlying models or source code.
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or used the Service in a way that harms us, other users, or third parties. For serious violations, we may also report activity to law enforcement.
9. Intellectual property
The Service, including the website, software, models, and branding, is owned by The Omniverse LLC and protected by copyright, trademark, and other laws. These Terms do not grant you any rights in our trademarks or branding.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that outputs will be accurate, lifelike, or suitable for any particular purpose.
11. Limitation of liability
To the maximum extent permitted by law, The Omniverse LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Doña Ana County, New Mexico, and you consent to the personal jurisdiction of those courts.
Nothing in this section limits any right you have that cannot be limited by law. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law gives you the right to bring proceedings in your local courts or to rely on the mandatory consumer protection rules of your home country, this section does not take that right away. It also does not affect your right to lodge a complaint with a data protection authority, or to pursue a judicial remedy under applicable data protection law, as described in our Privacy Policy.
